Navigating Gateway Two

Latest data on applications being approved, and call to contribute to consultation on proposals.

Recently published figures from the Building Safety Regulator (BSR) covering the period from 3 November 2025 to 24 January 2026 indicate that 32% of Gateway Two applications are currently being approved. During this timeframe, 698 decisions were issued across all categories of work, including new build, refurbishment and remediation projects. Of those decisions, 68% related to schemes located in London.

The BSR’s Innovation Unit is overseeing 111 live new-build applications. Of the 39 decisions issued by the Unit during the reporting period, 56% were ruled invalid, 18% were rejected and 13% secured approval. The regulator has stated that invalid submissions typically lack “basic design information”. Build UK’s Gateway Two guidance details the full range of documentation required for applications concerning both new and existing Higher-Risk Buildings (HRBs).

In addition, 29 legacy new-build applications submitted under the previous system remain outstanding. The BSR is reviewing each case to determine whether applicants should instead be invited to submit a fresh application under the current process.

Separately, the Ministry of Housing, Communities and Local Government (MHCLG) has opened a consultation on proposals to remove certain building control procedural requirements within the HRB regime. The changes would apply to specific types of work, including drilling through internal fire-resistant walls to install fibre optic cabling and carrying out installation or repair works to mobile communications masts. The objective is to ensure the regime remains proportionate while maintaining safety standards.
